Overview
Understanding the Charge
Capital murder is Arkansas's most serious homicide offense. It applies to certain intentional killings and to deaths occurring during the commission of specified felonies. A conviction means death or life without parole — there is no other outcome for adult defendants.
What the State Must Prove
- Premeditated, deliberate, purposeful killing
- Felony murder — death during rape, kidnapping, vehicular piracy, robbery, aggravated robbery, residential or commercial burglary, arson, felony drug offenses, first-degree escape, or terrorism
- Intentional killing of a protected public servant in the line of duty (law enforcement, firefighters, judges, military, teachers, correctional or community supervision officers)
- Murder for hire — either carrying out the killing for payment or hiring someone else
- Knowingly causing the death of a child 14 or younger under circumstances of extreme indifference, where the defendant is 18 or older
- Death caused by drive-by shooting — intentionally firing from a vehicle at a person, vehicle, or occupied structure

Without proof of the predicate felony, a felony-murder capital charge collapses to a lesser offense.
Mens Rea Challenge
Capital murder requires purpose or, in felony-murder cases, the specified mental state. Defeat the mental state, defeat the charge.

Even if guilt is found, mitigation evidence at the sentencing phase can take the death penalty off the table.

Where applicable, justification under § 5-2-607 is a complete bar to conviction.
